1. Proprietary Rights and Intellectual Property All contents, information, architectures, protocols, systems, software code, graphic designs, interfaces, and methodologies (“Materials”) presented on the HAIE ecosystem (haie.italyidentity.it) are the exclusive property of the founding entities: GARD (Global Alliance for Renaissance and Digitalization), Futuro Italia, and Superlab Technologies Italy.
All rights, titles, and interests—including, but not limited to, patents, utility models, registered designs, trademarks, copyrights, trade secrets, and industrial know-how—are protected under Italian, European, and International Intellectual Property laws. Any unauthorized use, reproduction, modification, distribution, or public display of these Materials, in whole or in part, without the express written consent of the rights holders, is strictly prohibited.
2. Scientific and Academic Integrity The HAIE ecosystem incorporates proprietary scientific research, academic publications, technical white papers, and theoretical frameworks developed by our research teams. All such documentation, whether published or held as internal intellectual capital, is protected by international copyright and academic property standards. Any reference to our scientific models, data sets, or research findings must be accompanied by proper citation and written authorization. Unauthorized appropriation of our research methodologies or data structures—whether for academic or commercial use—is considered a violation of our intellectual property rights.
3. Advanced Protection: Know-How and Industrial Secrets The methodologies, systemic flows, and architectural hierarchies displayed herein represent a unique intellectual asset. Any attempt to engage in “benchmarking” for the purpose of competitive replication, or any attempt to reverse-engineer the underlying logic of the HAIE ecosystem, will be deemed an act of malicious industrial espionage. We reserve the right to monitor access for security purposes and to pursue rigorous legal action against any entity found to be harvesting our systemic intelligence for competitive advancement.
4. Confidentiality and Anti-Parasitic Clause Access to this platform is granted strictly for the purpose of professional evaluation by authorized parties. By interacting with these systems, the user acknowledges that they are accessing information of a highly sensitive and proprietary nature. The user hereby agrees to maintain full confidentiality regarding any technical, strategic, or cognitive architectures disclosed. Furthermore, we explicitly reject any “open-innovation” misinterpretation: our ecosystem is a proprietary infrastructure, and all components are strictly protected against parasitic extraction. Any unauthorized effort to leverage our proprietary models for the development of competing systems, or to incorporate our strategic framework into the development agendas of third-party organizations without prior written consent, constitutes a breach of good faith and a severe infringement of industrial property.
5. International Protection The protection of our Intellectual Property, Scientific Works, and Industrial Secrets extends globally. We assert our rights under all relevant international treaties, including the WIPO Copyright Treaty, the Paris Convention for the Protection of Industrial Property, the Berne Convention, and the EU Directive on the Protection of Undisclosed Know-How and Business Information. Legal actions for infringement will be pursued in the jurisdictions where the violation occurs, and we reserve the right to seek injunctive relief, statutory damages, and any other legal remedies available under local and international law.
6. No Warranty and Limitation of Liability The information and systems presented are provided “as is” for professional assessment. While we strive for absolute accuracy, the founding entities make no representations or warranties regarding the completeness or suitability of the Materials for any specific industrial or academic purpose. The founding entities shall not be held liable for any direct, indirect, or consequential damages resulting from the use or inability to use this platform.
7. Non-Disclosure and Professional Collaboration The presentation of this infrastructure does not create any joint venture, partnership, or employment relationship. Any professional collaboration, investment, or technical exchange involving our proprietary research or deposited materials shall be governed solely by separate, written, and signed Non-Disclosure Agreements (NDAs) and Master Service Agreements (MSAs).
8. Dispute Resolution and Jurisdiction Any dispute, controversy, or claim arising out of or in connection with the use of this ecosystem, including questions regarding the existence, validity, interpretation, performance, or termination of these terms, shall be settled in accordance with the following hierarchical procedure:
Primary: Binding arbitration administered by the International Court of Arbitration of the International Chamber of Commerce (ICC), with the seat of arbitration in Paris or London, in accordance with the Rules of Arbitration of the International Chamber of Commerce.
Secondary: If not resolved via ICC, arbitration administered by the Arbitral Chamber of the Chamber of Commerce of Perugia (Camera Arbitrale della Camera di Commercio di Perugia), in accordance with its Rules.
Tertiary: In the event that arbitration is not initiated or fails to resolve the dispute, the Court of Perugia (Tribunale di Perugia), Italy, shall have exclusive jurisdiction to settle the dispute.
